Former GNPC Chief Executive Tsatsu Tsikata has been cleared of charges of causing financial loss to the state by a Court of Appeal.
The court in a ruling Wednesday said the incarceration of the legal practitioner by an Accra Fast Track High court for causing financial loss to the state in 2008 was a miscarriage of justice.
The Fast Track High court found him guilty for causing a financial loss of GHC230,000 to the state.
Despite receiving a presidential pardon in the nick of the 2008 elections, Tsikata has continued to fight for his innocence in the matter.
Background
Tsatsu Tsikata was sentenced to five years’ imprisonment on June 18, 2008 by the Accra Fast Track High Court for causing financial loss to the state through a loan that the GNPC guaranteed for Valley Farms, a private cocoa-growing company.
He was found guilty on three counts of wilfully causing financial loss of GH¢230,000 to the state and another count of misapplying public property.
His trial started in 2002 and travelled back and forth the court ladder until his sentence, which generated a lot of controversy.
Valley Farms contracted the loan from Caisse Francaise de Development in 1991 but defaulted in the payment and the GNPC, which acted as the guarantor, was compelled to pay it in 1996.
Mr Tsatsu Tsikata was unconditionally pardoned by former President J.A. Kufuor on his last day in office but he rejected the pardon and insisted that he would continue to pursue justice in the court of law.

You have justice at a competent court of jurisdiction when you thought you were unfairly jailed by another competent court. Its a shame that those people tried under the Kangaroo court you helped established under the PNDC era did not get the same justice. Tsatsu Tsikata, you know the number of extra judicial killings you have directly or indirectly participated in during the PNDC era. God is watching and you will surely answer to him one day. So just s-h-u-t up.
Can some answer these questions for me? 1. Did Tsatsu Tsikata reject the presidential pardon from former president J. A. Kuffour? 2. If he did, how come he spent sic months in Nsawam and not the five years he was supposed to be there? 3. By what procedure did Tsatsu Tsikata have his jail term discontinued? 4. Does a convicted person who receives pardon and takes advantage of it have the right of an appeal? This is just one of the 419 schemes in law. This appeal will be quashed by the apex court. It is an insult to true substance of the law.
Is anybody surprised especially considering that Dennis Adjei is an NDC man and is also lobbying to be promoted to the Supreme Court.

Martin Amidu will have no place if Nana wins this election not because he is from NDC but mostly because he is a northerner. he should find out from Paul Afoko. the likes of Amidu and Bugri BASABASA NABU who are allowing themselves to be used against Mahama are fighting him in vain. the man is still calm, composed and certain of victory. this verdict is proof that NANA ADDO is not the astute lawyer he is touted to be. he hopes to win election and use state powers for witch-hunting of Ewes as kufour did and vengeance against his own. I trust even the Ashantis who know him well will reject him as they did in the last election. He harbours grudges against too many has only 6 days left in the limelight. Yesterday I heard Tatsue and his wife praising God for this dubious ruling and I told myself God sit where you are please don't come down. Even armed robbers when they go for operation and they are not arrested they thank God for it. You Tatsue you have caused financial loss to the state. You have wasted tax payers money and you think that we should praise you for it. Then well done. Today your party is in power so you can pass through the back door and get this stuuuuuupppid ruling but God who knows everything is watching you! This is one more reason we need to separate the Justice Ministry from the A-G Department. I bet the A-G's office didn't put up a fight. Acceptance of the presidential pardon should had brought a closure to this case. I'm hoping this not the end of this case. It should be about Tsatsu but for the right interpretation of a presidential pardon. I hope somebody would challenge this dubious ruling in our apex court. If Tsatsu were to be say NPP member, the A-G would had put on a fight.
How can a court of appeal cleared a "cr1m1nal" who has accepted a presidential pardon? He can't have his cake and eat it at the same time. He protested the pardon but he accepted it and walk out of jail. Whether Jonas swallow the whale or the whale swallow Jonas, there was a swallow. I'm not a lawyer nor a judge but this can't be right. What was the meaning of the acceptance of the presidential pardon? Was it a joke or what? The judge should be investigated. Common sense tells me this is not right period.
