Maxwell Totimeh, a 32-year-old driver, was on Thursday convicted to a fine of GHC 1,000 by the Mpraeso Circuit Court for careless driving and negligently causing harm.
The court presided over by Mr Alex Owusu Ofori, ordered that GHC 800 out of the fine should be paid to Mr Oheneba Kissi, News Editor of Obuoba FM station, whose right leg was amputated as a result of the accident.
Patrick Owusu, elder brother of Kissi, died in the accident that occurred at Adensua near Nkawkaw on the Accra/Kumasi road last year.
Prosecuting, Detective Police Inspector Christian Apronti of the Nkawkaw Divisional Motor Traffic and Transport Unit (MTTU) told the court that on October 26th, 2008 Totimeh was driving a DAF truck with registration number GT 9081 X, loaded with building materials from Kumasi to Tema.
He said on reaching a section of the road at Adensua near Nkawkaw, Totimeh attempted to overtake an articulator truck and in the process, collided with a Nissan Urvan bus driven by Oheneba Kissi from the opposite direction.
The prosecutor said Oheneba Kissi and his brother were seriously injured and were rushed to the Holy Family Hospital at Nkawkaw and later referred to the Okomfo Anokye Teaching Hospital in Kumasi and the Koforidua Regional Hospital respectively.
He said on November 02 Owusu died while on admission and on November 04, Kissi's right leg was amputated and later discharged.
