"Freed" Ken Agyapong Slapped With Fresh Charges

Peacefmonline.com can authoritatively confirm that the Attorney-General's Department has preferred new charges against embattled NPP Member of Parliament for Assin North, Kennedy Agyapong, who was set free a few moments ago. State Prosecutors, on Friday, filed a Nolle Prosequi at the High Court stating it was no longer interested in pursuing the charges of treason felony, attempted genocide and acts of terrorism against Mr Kennedy Agyapong. But in a matter of minutes, the outspoken NPP MP was re-arrested and slapped with lesser charges of "Provocation of Riots" and "Offensive Conduct" conducive to the breach of the peace. Mr Agyapong has already been to the Police Headquarters to write his caution statement on the fresh charges. The new charges preferred against him is bailable by law. Lawyer for the NPP firebrand, Ayikoi Otoo, who confirmed this a short while ago, however said he was not surprised by State Prosecutor's action since it vindicates his earlier view that the charges preferred against his client were strange. He also indicated his readiness to face-off with government over the "misdemeanor" charges. This latest move by the A-G's department to file for a Nolle Prosequi and later re-arrest the Assin North MP and slapped him with lesser charges, comes on the heels of the unanimous decision by the Supreme Court, to throw out an application for certiorari brought before it by State prosecutors seeking to quash their own case at the High Court against the NPP MP. The A-G's department was severely tongue-lashed by some legal brains for preferring charges that were alien to the country's statutes against the NPP firebrand. All Five Supreme Court Justices who sat on the application for an Order of Certiorarai filed by State Prosecutors last month, rebuked the A-G for consciously going to the wrong forum and directed the Attorney-General's Department to go back to the High Court and right the wrong created by itself.
