Johnson Asiedu Nketia, popularly known as General Mosquito, the General Secretary of the National Democratic Congress (NDC), faces contempt of court with the party�s national chairman, Dr. Kwabena Adjei, and three others after they were said to have disregarded an injunction filed restraining them from conducting a primary in Buem.
The injunction was filed by Alhaji Bello Adams, a member of the party, before an Accra High Court to restrain the respondents including Elias Dzenu Mohammed Shani and Kwasi Aboagye, the Volta regional chairman of the NDC, from conducting the primary till the final determination of the substantive matter concerning the disqualification of Kofi Adams, the deputy General Secretary of the party from contesting the Buem seat.
The respondents were said to be aware of the interlocutory injunction which was to be moved on January 29, 2013 but quickly went ahead to conduct the primary with the help of the district electoral officer of the area, Mohammed Shani, on Sunday, January 27.
In his affidavit in support of the contempt motion filed by Dr. Kwaku Nsiah, his lawyer, in Accra on February 4, 2013, the applicant, Alhaji Adams, said the respondents were aware of the injunction, yet they went ahead to conduct the primaries.
He said the Volta regional NDC chairman, in an interview on Joy FM, an Accra-based radio station, admitted they were aware of the injunction.
According to him, the action of the respondents was tantamount to arrogating themselves certain powers meant for the High Court and therefore put the administration of the law into disrepute.
He said the action of the respondents amounted to interference with the pending proceedings at the High Court which was contemptuous.
The applicant said the action of the respondents, especially the Volta regional chairman, was willful and so they should be punished accordingly.
Kofi Adams, who showed interest in the Buem seat after it became vacant, went through all the process required of interested applicants and was vetted by the party at the regional level.
He was said to have been okayed by the party but was suddenly disqualified so the applicant filed an interlocutory injunction restraining the party from going on with the primary till the matter was determined by the court.
