Impotent Man Cleared Of Rape

A 68 year old unemployed man, who was accused of having sexual intercourse with a 13 year old girl, was yesterday acquitted and discharged by an Accra Circuit Court, after a medical report had proven that he was impotent. Edward Bortey was accused by an anonymous character about an alleged sexual activity with the victim, and has been in custody since 2012. He was charged with defilement of a female under 16 years, contrary to section 101 (1) of Act 29/60, as amended by section 11 of act 55/98, to which he pleaded not guilty before the court presided over by Ms. Sedina Agbemeva. A police medical report presented after the prosecution had closed its case indicated that Edward Bortey looks weak, and that artificial erection by way of excitation of the erection nervous path could not achieve erection. According to the report, the abdomen was normal, but with a scar on the Rt inguinal fossa, which is an indication of a hernia operation done about ten years ago. The report concluded that no penile erection was achieved. Edward Bortey was subsequently acquitted and discharged, since the prosecution could not prove its case beyond reasonable doubt. ASP Sarah Acquah, narrating the facts of the case, stated that on November 19, 2012, the police Domestic Violence and Victims Support Unit (DOVVSU) of Nungua received information from a young man, who pleaded anonymity, to the effect that on, or before, November 19, 2012, Edward Bortey had sexual intercourse with the victim. She said, based on the information, the police moved in and traced the victim. �However, in the course of police investigations, a witness in the case, who is the Project Coordinator of the Presbyterian Child Development Center, Nungua, also showed up with the same information in respect of Edward Bortey�s sexual activities with the victim, and went ahead and confirmed his outfit�s support of the investigations,� she emphasised. According to her, the police medical report form was issued, and the victim was taken to hospital for treatment, and a full report was submitted on her.
