Atuabo Chief Files Another Motion In Court

THE Omanhene of Eastern Nzema Traditional area, Awulae Amihere Kpanyile III, who has been battling the management of Ghana Gas at a Sekondi High Court, has filed a motion at the same Court for the recovery of the land, where the gas plant has been sited. The motion, which would be heard by the Court on the 4th of July, 2014, comes after the management of Ghana Gas admitted in its statement of defence that it has no title to the land on which it was building the gas plant. It was upon this admission by the Ghana Gas that the Omanhene, who is the plaintiff in the case, is asking the Court for judgement to recover the land in question. It would be recalled that the Court, presided over by Justice Kofi Akrowiah granted a 14 day limited injunction, which it later vacated, barring any activity on the land. After the vacation of the order, the government announced in widely publicized statement that it had compulsorily acquired the land in the interest of the state. Correction IN THE Monday edition of this newspaper, we published that the application to vacate the order of injunction granted by the Sekondi High Court was filed without reference to the plaintiff and his lawyer. Subsequent checks at the court revealed that the application was indeed served on the lawyers of the plaintiff, Messrs Amua Sekyi & Co. The correct position is that the lawyers for the plaintiff wrote a letter to the court asking that the application be heard on the 24th of June 2014 a date which had earlier on been agreed to by all parties and their lawyers but the court however proceeded to hear the application and subsequently granted the order vacating the injunction. Further checks have also revealed that the order of vacation only affected Sinopec and Ghana Gas Ltd. Thus the order for injunction still holds good against all the other defendants.
