AIDS Ambassador�s Action Is Fraudulent...Liable To Both Civil And Criminal Suit - Lawyer

Private Legal Practitioner, Lawyer Kissi Adjabeng has concluded that the action of Joyce Dzidzor Mensah, Ghana�s highly respected HIV/AIDS Ambassador, who admitted lying to the public on her status to solicit for money is fraudulent. According to him, the intention of the AIDS Ambassador to lie to the public to create awareness of the existence of HIV/AIDS is not the issue but using the lies to solicit for money for any noble course is an offense she cannot be forgiven. Speaking on Oman Fm�s Morning Show, the Law Lecturer asserted that it is offense if she used the money to take care of orphans and to prevent others from contracting the HIV/AIDS. He however insisted that since people gave her the money based on her sickness, she cannot be pardoned; describing her action as almost fraudulent as people would not have given her the money if not for her sickness. He therefore stated that her offense can be both criminal and civil case; in that, she can be prosecuted for defrauding by false pretence and in the civil case, the individuals who can evidently prove that the lady collected from them on the account of her sickness can send the case to court. �She has committed an offense and it doesn�t matter whether she used the money to help orphans and prevented people from contracting HIV/AIDS. The motive behind committing the offense will not help her; we are rather looking at her offense and not the motive. People gave you money based on your sickness and maybe if not your sickness, they wouldn�t have given you the money�..it is almost fraudulent, I�m being charitable here but as for your good intentions, they help at all except to reduce the sentence. She is liable to two offenses in this case; criminal and civil case�, he explained.
