State prosecutors in the trial of Dr. Sulley Ali Gabass, the senior medical doctor at the Effia Nkwanta Regional Hospital in Sekondi standing trial over sodomy, have begun quizzing the accused.
This was after the court had completed taking the evidence of the accused, which started June 1, 2015.
Although the case was heard in camera at the Accra Gender-Based Violence Circuit Court presided over Mrs. Rita Agyeman-Budu, DAILY GUIDE gathered that the prosecution had started the cross-examination of the accused medical doctor.
Hearing has been adjourned until June 9, 2015 for the prosecution to end its cross-examination.
On Monday, John Benson, lead counsel for Dr. Gabass, mounted a strong defence regarding his client’s HIV status.
He argued that a report the defence team had tendered to the court showed that the accused person was HIV negative.
State prosecutors had alleged that Doctor Gabass had transmitted HIV to the 16-year-old senior high school boy he is accused of having anal sex with.
But Mr. Benson argued that Dr. Gabass had nothing to do with the HIV positive status of the victim.
Dr. Ali Gabass has been in custody over a two-count charge of defiling a child under 16 years and unnatural carnal knowledge – an offence he has denied.
He is alleged to have in the months of October 2013 and April 2014 at Kasoa and Alajo in the Central and the Greater Accra Regions respectively, had unnatural carnal knowledge of the victim aged 16.
According to the police, during the month of October 2013, Dr. Gabass arranged and met the victim at the Kasoa New Market area where he forcibly had anal sex with the boy in the former’s car in front of the Kasoa HFC Bank.
During police interrogation, Dr Gabass admitted knowing the victim as a friend, but denied having anal sex with him.
