Julius Ansah has descended on the Attorney General's (AG) department and warned it to stop wasting the time of the court anytime they appear before it on cases regarding constitutional matters.

The panel, while venting their spleen in court yesterday regarding a suit filed by Justice Paul Dery, said they wondered why the AG’s department will be requesting for extension of time to file their affidavit in opposition when they were served a month ago.

The Justices of the Apex Court told a Principal State Attorney, Mrs. GraceAwoal to desist from such unnecessary delaying tactics after she requested for extension of time to enable them file their submission.

In her response, she told the court that the delay was due to the inability of the Registrar who is also a party in the case to co-operate with them.

Mrs Awoal who appeared in two separate cases filed by Justice Dery yesterday requested for time extension for both cases and that provoked the five-member panel. She was, however, given seven days in each of the cases to respond. The cases have been adjourned sine die.

The embattled high court judge is seeking 10 reliefs against Tiger Eye PI, a private investigation firm owned by Anas Aremeyaw Anas, the Chief Justice, and the Attorney General, as the first, second and third defendants respectively.

He is also urging the Supreme Court to exercise its supervisory role to quash a High Court ruling which dismissed his application of contempt application against EIB and three others earlier.

Justice Dery is one of the 12 high court judges caught on video allegedly taking bribes to pervert justice. Twenty-two Circuit Court judges and Magistrates involved in the judicial bribery scandal have been suspended.

Reliefs

Justice Dery is asking the court to declare that Anas’ Tiger Eye’s publication of its Petition to the President in the media contravened Article 146 (8) of the 1992 Constitution and therefore unconstitutional.

A declaration that the 2nd Defendant acting through the Judicial Secretary’s Press Release dated 11th September, 2015, naming the Plaintiff as one of the twelve (12) High Court Judges involved in the “Bribery Scandal” is in contravention of Article 146 (8) of the 1992 Constitution and therefore unconstitutional.

A further declaration that the Petition presented to the President by the 1st Defendant is null and void on account of the 1st Defendant’s contravention of Article 146(8) of the 1992 Constitution.

Justice Dery is also seeking a perpetual injunction restraining the 2nd Defendant, her agents, assigns, servants and successors from any further impeachment proceedings against him.
