Former PM To Drag KMA Boss To Court

The Mayor of the Kumasi Metropolitan Assembly (KMA), Hon Kojo Bonsu, will soon be served with a fresh legal suit for allegedly collecting revenue from residents within the metropolis when the assembly currently has no Presiding Member (PM).

According to a former PM for Ejisu Juaben Municipality, Hon Nicholas Owusu Sekyere, who is preparing to take the matter to court, the ongoing collection of revenue is clearly a violation of the Local Government Act 1993 (Act 462).

He said Fee Fixing Resolution needs the validation of a PM, who by law, is authorised to do so before its implementation.

Hon Sekyere in an interview with the DAILY HERITAGE called for the impeachment of the KMA boss as a matter of urgency since he sees no reason why the Assembly steered by the KMA boss still collects revenue and spends from the Internally Generated Fund without the Fee Fixing Resolution which has not been approved for 2016 since no new PM has been elected yet.

The former PM added that he has given the KMA boss a grace period of 30 days, which began from 4th February 2016, as was contained in a letter of notice addressed to the Mayor dated 4th February 2016.

He said the “KMA Mayor must realise that the assembly is governed by law and that without a PM, it is a default Assembly.”

Hon Sekyere maintained that the KMA per the status-quo cannot meet to discuss anything for the development of the metropolis since the Assembly does not exist as established by law and for that reason whatever they do is illegal.

He has, therefore, challenged the assembly to give a vivid account audited by the Auditor General on all revenues collected so far, adding that all proceeds should be in a separate account until the above mentioned default is corrected.
