A former president of the National Association of Local Government Authorities of Ghana (NALAG), George Kyei Baffour, is threatening a legal suit over what he calls the illegality being perpetrated by parliamentarians of Ghana.
Speaking to Citi News, Mr. Kyei Baffour said the two-decade practice of dolling out part of the Common Fund to parliamentarians is an illegality which ought to be checked.
He said MPs only have the authority to approve the formula and do due diligence on the issue.
According to Mr. Kyei Baffour �Article 252 of the Constitution clearly state unambiguously that 5 percent of total revenues of Ghana shall be set aside for distribution to district assemblies for development and members of parliament are supposed to approve the formula.
�Their only function here is to approve the formula so they cannot under any circumstance access some of the funds because they are not development agents by the constitutional provisions.�
He added: �It is not their responsibility to allocate resources to themselves. Even besides that look at the structure and the standing orders of our Parliament, they do not have the authority to disburse public funds.
�We need to go to the Supreme Court for the court to determine the authenticity of the Act of Parliament, it is an illegality.�
