An Accra Circuit Court has acquitted and discharged two persons, Samuel Dzortepeh, a driver and Jiblila Musa, welder for want of prosecution.
Samuel and Musa, who had already spent five years on remand, were arrested on April 18, 2010 for conspiracy to commit crime and robbery at Dzodze in the Volta Region.
Justice Francis Obiri, giving the ruling, said the prosecution could not prove the guilt of the accused persons.
He said he was surprised the prosecution did not call the material witness in the case, who was the complainant to even identify the accused persons.
Samuel and Musa were alleged to have conspired and robbed a driver of his Urvan Mini Bus with registration number GS 5581-09 on April 8, 2010.
According to the facts, they were arrested after an attempt to sell the bus to a police officer, who posed as a buyer.
Mr George Asamaning, the Counsel for Samuel and Musa, expressed gratitude to the Trial Judge for making justice prevail.
