Former Assin North Member of Parliament, James Gyakye Quayson has appealed the High Court ruling which nullified his election as the Member of Parliament for the area.
In a writ sighted by Peacefmonline, he noted that the Cape Coast High Court erred in its ruling.
"The High Court acted out of jurisdiction by not referring the interpretation of Article 94 (2) (a) of the 1992 Constitution to the Supreme Court".
Assin North Polls Cancelled
The Cape Coast High Court last Wednesday ruled that at the time of filing his documents to contest the election in Assin North, Mr Quayeson still held allegiance to another country other than Ghana.
The Court thus cancelled the said election, ordering a re-run of the poll in Assin North, and, consequently, further asked Mr. James Quayson to desist from holding himself out as MP for the area.
But in a 6page document filed on Monday, August 2, 2021, at the Cape Coast Court of Appeal, Mr. Quayson said the ruling delivered by the High Court presided over by Justice Kwasi Boakye was characterized by a lack of due regard of the law.
He is thus asking the Court of Appeal to set aside the orders and costs awarded in the said High Court Judgment.
Reliefs Being Sought
1. A declaration that the judgment of the High Court, Cape Coast, Coram Kwasi Boakye Jj. dated 28th July 2021, is void for having been issued out of jurisdiction.
2. An order setting aside the judgment of High Court, Cape Coast, Coram Kwasi Boakye J., dated 28th July 2021.
3. An order setting aside the award of costs against the appellant and in favour of the petitioner/respondent and the 2nd Respondent/Respondent
4. Costs in favour of the appellant.
5. Any further or other order(s) the Court may deem fit.

No one should be ***barred word*** that this is a political manipulation. Some members of his party, were alleged to have brought up the issue, well before he signed the EC documents. These naive thoughts will get this guy into more trouble. He already violated a court injunction not to get sworn-in, against the advice of parliamentary clerks, against the parliamentarians for his defiance. He is now on a PATAPAA path to self-destruction, and its associated humiliation. He certainly will be remembered; 'The guy whose adamant stance, caused the January 2021 Bruhaha in parliament. Causing a humiliation to the country. I wish him luck on this one. At best, he is turning 70 soon, and Ghana, I heard, does not keep 72+ years prisoners. Hmm, may be it is worth fighting, so final judgment comes after he is 72. Sorry ooh.
This time i think the appeal court judges will show that they didn't study law to help nana addo and the npp government but they did so because that is what God has called them to do. They fact that he has increased your pay doesn't mean you should do his bidding. Afterall he didn't pay your law school fees for you. He has also increased his pay by 79%. Each one for himself God for us all. He is 77, very close to meeting his maker, so why allow him to manipulate you for his selfish interest.
