Church Drags AMA To Court

The Liberation Chapel International Church and four individuals have dragged Accra Metropolitan Assembly (AMA) to court for attempting to eject them from their private property. Also joint to the suit are the Mayor Accra, Dr. Alfred Oko Vanderpuye and one Abena Kwesiwaa Kyei of Abeka. The plaintiff are seeking in order of injection directed against the AMA, Dr. Vanderpuye and Abena Kwesiwaa Kyei, their agents, workmen/or assigns from entering into evicting or demolishing the properties situated at and being at Mallam near the George Walker Bush Highway Interchange. They are also seeking an injunction to restrain the defendants from interfering with the quiet and peaceful enjoyment of their land. The plaintiffs are further asking the court for a declaration that the demolishing of the properties of the plaintiffs and /or their forcible eviction from their lands by the defendants except pursuant to an order of a court of competent jurisdiction is a breach of the 1992 Constitution of Ghana and their fundamental human right. In addition, the plaintiffs are seeking a declaration of title to the individual lands and more particularly delineated in the schedules. According to the Plaintiffs, Dr. Vanderpuye and the 3rd defendant on the 24th of February 2012 personally organized armed people who stormed their properties and ordered them to vacate the land and marked their buildings and structures for demolition. The Plaintiff said their land do not form part of the land do not form part of the land annexed by state for the construction of the said Highway. Plaintiff further stated that persons affected by the construction of the Highway had been identified and compensated by the state but they were never contacted by anyone that their land had been appropriated and no compensation has been paid to them. Plaintiff further pointed out that the defendants have demolished some properties in the area without just cause and have threatened to demolish all structures on the land and evicted the plaintiffs from their land. The Plaintiffs also said the threatened actions of the defendants is a calculated effort at removing them from their land in the expectation that the completion of the interchange will boost economic activities in the area and a well schemed effort at using subterfuge to annex unlawfully, properties of law abiding citizens. The case is slated for hearing in Accra High Court soon.
