'Bold' Kumbuor Must Advise Mills On Unconstitutional Decision - Amidu

The former Attorney General and Minister for Justice, Martin Amidu has questioned why his successor Dr Banjamin Kumbuor wasn�t bold enough to point out to President Mills that Cabinet�s decision not to sell a state property to NPP Chairman Jake Obetsebi Lamptey despite a Supreme Court ruling which cleared the sale was unconstitutional. Cabinet on Thursday issued a statement describing the sale of the bungalow as �immoral� and thus decided against the sale in the best of Ghanaians. Mr. Amidu in a statement described the decision by Cabinet as unconstitutional and against the founding principles of the NDC. He later told Accra-based Citi FM in an interview that he expects his successor Attorney General Dr Benjamin Kumbuor to shun timidity and clearly and boldly point out to the President that the Cabinet decision is unconstitutional. Mr. Amidu said �this is purely a legal matter and the constitution under Article 88 invests in the Attorney General the power to institute and conduct proceedings on behalf of the government. �He [Benjamin Kumbour] has the prime responsibility, ethically to tell the government that what they are doing is unconstitutional �How many Attorney Generals can the President dismiss, Number stands his ground, like I did, sacked, the number stands his grounds, sacked, number three stands his ground, will you sack him� He queried. Mr. Amidu also stated that the reason given by the Government for reversing the sale of the property despite a 6-3 majority Supreme Court ruling that gave the sale a clean bill of health amounts to impugning the integrity of the highest court of the land and also inciting Ghanaians against the Supreme Court.
