Two Disqualified Party Leaders Drag EC To Court

Two individuals whose hopes of leading their respective parties to the December polls were dashed by the Electoral Commission (EC) have dragged the EC to court to seek redress. The Independent People Party, IPP in a joint suit with its flagbearer, Kofi Akpaloo, and the flagbearer of the New Vision Party, Prophet Daniel Nkansah, have sued the Electoral Commission at separate High Courts in Accra. The application by the flagbearer for the New Vision Party could however not be heard because the lawyers for the EC did not receive the notice on time and needed time to study the documents. The count thus adjourned the case to today. The fate of Mr. Akpaloo and his party will be known by Tuesday the 6th of next month, when the fast Track High Court presided over by Justice Utter Paul Dery, gives its ruling. The IPP is seeking an order of mandamus to compel the EC to register its flagbearer for the forth coming elections. Their lawyer Richard Laapo, explained that this action has become necessary because the commission as a Public Institution, failed to carry out duties. Mr. Laapo, observed that his client was not given room for consideration as the Electoral Commission only took a cursory look at the form submitted. In view of this, they are praying the court to order the EC to register their Presidential Candidate for the 2012 elections. Mr. Laapo said the action of the EC to refuse the party's presidential candidate is unacceptable in law and hence the EC has acted arbitrary to what exist in the constitution.
