Supreme Court opts for early adjournment

The Supreme Court on Monday adjourned its sitting early to enable Dr Mahamudu Bawumia, the second petitioner, examine a list of documents provided by Mr Tastsu Tsikata, counsel for third respondent in the Election Petition Hearing. Mr Tsikata, who provided the list to the witness, admitted that it was long and would take some time for him to finish checking. He, therefore, agreed with Mr Addison, lead counsel for the Petitioners, for hearing to be adjourned to tomorrow Tuesday to allow Dr Bawumia to properly examine the documents and provide its counterpart pink sheets. Earlier, the court overruled an objection raised by Mr Addison at the last adjournment that Mr Tsikata should not be allowed to cross-examine the witness on a document that had not been exhibited and tendered before the court. Mr Tsikata had argued that the document was taken from another document which the witness had already confirmed to the court. Justice William Atuguba, the presiding judge reading the ruling, said the list of 32 exhibits sought to be tendered was based on questions and answers emanating from the pink sheets to which it related. The court said since the evidence relating to it was already on record, the list which was merely an index to the pink sheets covered by it, was merely facilitating for tracking the evidence already so covered. The court overruled another objection by Mr Addison that Mr Tsikata could not proceed to ask questions on a document that was not before the court. He said if the court still wanted Mr Tsikata to go ahead to ask the witness questions on a document that was not before it, he prayed that similar courtesies would be extended to the petitioners if the time comes. At that juncture the judges asked Mr Tsikata to clarify the sort of documents he had in his possession. He explained the documents were based on a list of exhibits provided by the witness and on which he had a number of questions to ask. The court then overruled the objection by Mr Addison and asked Mr Tsikata to continue his cross-examination. Hearing continues tomorrow Tuesday.
