Andrew Awuni Has Locus To Sue In Merchant Takeover - Faibille

Egbert Faibille, counsel for anti-corruption campaigner Andrew Awuni has asked a commercial court in Accra to dismiss an application filed before it by Fortiz Equity Fund. The application filed by Tony Lithur, counsel to Fortiz Equity questioned the Locus of Mr. Awuni to sue for an injunction to be placed on the sale of ailing Merchant bank to Fortiz Equity. Tony Lithur argued in court Tuesday that, per the statues of SSNIT, it is only a trustee that can pursue a legal action against the Trust. But council for Mr. Awuni argued that he has the capacity based on the fact that he is a contributor to SSNIT which owned 90 percent shares in the bank. The court, presided by Justice Rosetta Bernasko-Essah has adjourned the case to 18th of December to rule on the matter. Mr. Andrew Awuni is expected to withdraw an earlier application before the High Court suing the Bank of Ghana, Fortiz Equity, SSNIT and two others. This will pave way for a continuation of the amended application before the commercial court to be heard if his locus is determined in the matter.
