Another Big Blow To NPP ...As NDC MP Defeats Them In Court

The NPP has suffered another court defeat in a case filed against the Member of Parliament for Ahafo Ano North Constituency, Hon Kwasi Adusei. The NPP through their Parliamentary Candidate for elections 2012 petitioned a Kumasi High Court against the election of NDC Member of Parliament for the Ahafo Ano Constituency. Mr. Richard Akuoku Adiyiah petitioned the High Court to annul a substantial number of votes due to allegations of over-voting and voting without biometric verification but lawyers of the respondents pleaded the Court to dismiss the petition for delayed filing of the application. The High Court however held that the petition was filed in time and ordered for hearing of the substantive case. The lawyer for the 1st respondent Lawyer Abdul Mujeeb who was not satisfied with the High Court decision filed an appeal at the Appeals Court in Kumasi. The 1st respondent argued before the Appeals Court that the petition was in breach 18 (2) of the PNDCL 284 which provides that �a petitioner should pay security for cost within 21days to be determined by the court�. Justices E. K. Ayebi, Irene Dankwa and I. O. Tanko Amadu sitting the appeal upheld the argument of the 1st respondent and dismissed the petition. Meanwhile, a Co-Founder Organized Youth of Ashanti (OYA), Brogya Genfi has in a message to Hon. Kwasi Adusei congratulated him on his Victory and urged him to focus to deliver the promises he made to his people.
