Continuous Refusal Of Bail To Kwaw Kese Shameful � Kwame Akuffo

Private legal practitioner, Kwame Boafo Akuffo has described as shameful the continuous refusal of bail to Kwaw Kese by a Kumasi Circuit court. The hiplife artiste who is standing trial for publicly smoking weed was refused bail for the fourth time today, Tuesday in spite of concerns over his state of health. The case has been adjourned to January 5, 2015. But Boafo Akuffo believes the court is abusing the prerogative powers granted to judges by the constitution to grant bail to accused persons. He wrote on his Facebook: �It is the duty of a judge when called upon in a bail application to respect the tenets of the Constitution and not to defer to subordinate legislation when the Constitution beckons�. He added: �The continuous refusal of bail by the Magistrate in the Kwaw Kesse case is a remnant of the Star Chamber attitude. The Magistrate is so wrong. It is beginning to border on the abuse of the process. A society built on law or one founded on whims and caprices? The latter holds sway. It's a shame�.
