Showbiz icon and broadcaster, Kwasi Kyei Darkwa aka KKD, who is standing trial for allegedly raping a 19-year-old student, was seen limping in court yesterday. At 10:00am when the case came up for hearing at the Adjabeng District Court presided over by Mrs Adwoa Akyaamaa Ofosu, KKD, 49, was without his usual stylish walking stick and was assisted before he could mount and dismount the dock. Making his second appearance in the court, sporting a blue long-sleeved shirt over a cream pair of trousers, the accused looked frustrated yesterday. He was said to have reported to the Police Hospital for medical treatment due to malaria. His counsel, Anthony Forson, told Presiding Magistrate Adwoa Akyaamaa Ofosu that he would need advice from ACP Atimbila, the State Prosecutor, regarding the proceedings because a bail application was pending before a Human Rights Court. ACP Atimbila said he was also waiting for advice from the Attorney General�s office and that it would be improper for him to give advice on what the court should do. After listening to both sides, the court adjourned the case for two weeks as it awaits the High Court�s ruling on the bail application which has been fixed for January 13. KKD was picked up for allegedly raping a 19-year-old girl in a bathroom at the African Regent Hotel on December 27, 2014. The victim was not in court but about five of her family members were present at the brief hearing. According to the family, the victim was very traumatised by the circulation of her name and photographs on social media. Even feeding is a problem, the sources said. Arrest KKD has since December 27, 2014 been in the custody of the Airport Police in Accra after he was picked up from the African Regent Hotel. He was subsequently arraigned before the Magistrate Court where he was denied bail and accordingly remanded into police custody. KKD has been charged with rape although his plea has not been taken. He is said to have had carnal knowledge of the victim (name withheld) without her consent at the bathroom of the African Regent Hotel in Accra. Bail attempts In an attempt to secure bail, lawyers of the embattled ace broadcaster filed a motion on notice for bail pending trial at a Human Rights Court in Accra which could not also be heard because prosecution said it received notice of the motion at about 4:00pm on Tuesday and could not file a response the next day. No Show The trial of the case at the Magistrate Court yesterday could not continue because the court was waiting for the advice of the A-G. This was after Anthony Forson Jnr, lead counsel for KKD, had told the court that there had been some new developments in respect of the case since the last adjourned date. He disclosed that they had filed an application for bail at the Human Rights Court but it could not also be heard because prosecution said it needed some time to study the matters raised in the affidavit in support. According to Mr Forson, the court had fixed January 13, 2015 to hear the application and as a result wondered if prosecution could give any advice in that regard. Responding, the prosecutor, ACP Moses Atimbila, stated that under the circumstances he was unable to give any advice, adding that �it�s not even proper for me to do so.� The trial magistrate accordingly adjourned the case to January 22, 2015, explaining that the court was waiting for the advice of the AG. According to ACP Atimbila, at about 7:30pm on the aforementioned date, there was an event dubbed �RIP the RUNWAY Fashion Show� organised at the African Regent Hotel, which the complainant attended with her cousin. He said when the two arrived at the venue, they met the accused person in front of the hotel and after the exchange of pleasantries, they walked into the lobby where KKD introduced them to his cousin. The prosecution said the complainant and the cousin took a few pictures with the accused person, his cousin and other men. ACP Atimbila said KKD, who admired the height of the complainant, asked her and her cousin to accompany them to the hotel room to apply powder on his face before the show, since he would be on stage and be captured by TV cameras. According to the prosecutor, the complainant and the accused took a lift to the third floor of the hotel and went into the hotel room together with her cousin and KKD�s cousin. He noted that they were offered drinks but they refused and sat down, adding that whilst there, KKD called the complainant to come and help him do the make up in the washroom, to which she obliged and entered the washroom leaving the two others in the living room. ACP Atimbila stated that KKD forcibly had sex with the complainant in the washroom and a report was made to the police and medical form issued to her. Prosecution said when KKD was arrested, he denied the offence and stated that the complainant gave her consent and that he did not force her.
