Tier 2 Pension Case Adjourned

An Accra High Court, presided over by Justice Alhaji Saeed Kwaku Gyan, has adjourned the case involving the tier-2 pension dispute between 12 labour unions and the government, after counsel for Bank of Ghana failed to move the case, during the court sitting yesterday.

According to the counsel for BoG, Samuel Cudjoe, he could not move the motion because he had no prior knowledge of the proceedings on January 26, 2015, and that he was not served. He said he only heard about the court hearing on radio in the morning and that he did not receive any official notification from the court.

Justice Saeed Kwaku Gyan, after listening to the plea of the counsel, adjourned the case to January 29, but reprimanded the bailiff and warned that he would not tolerate such improper service in the future. The twelve labour unions had been jointly sued by the government for embarking on strike actions without due process.

The government among other things is asking the court to declare that it is indeed the employer that has authority to appoint a trustee to manage the tier two pension funds of the workers. This, the unions have vehemently challenged. The workers also issued a counter claim, asking the court to compel the Bank of Ghana to disclose details of the tier 2 pension funds lodged with the bank whilst responding to the claims by the government.

The workers suspect the tier two pension funds have been tampered with but the Bank of Ghana filed an application seeking to dismiss the counter motion filed by the labour unions. According to Samuel Cudjoe this is not the first time the bailiffs have failed to serve them with writs for hearings. He said on two occasions, the bailiff failed to serve the Central Bank.
