Court Stops Takoradi Shopping Project

The Commercial Division of the Sekondi High Court has granted an interlocutory injunction brought before it on the construction of a proposed Shopping Mall in Takoradi.
                                
The injunction, which was filed by Mr. Peter Obosu, Managing Director of Peekob Company Limited, following attempts by some politicians in the Sekondi-Takoradi Metropolis to sideline him in the execution of the project, was granted by Justice Kofi Akrowiah on January 27, this year.

It was reported last year that a tussle ensued between Peekob company Limited and Western Development Consortium Limited (WDCL), a company purportedly formed by some politicians in the Sekondi-Takoradi Metropolis, over who has the right to receive the $1.6 million as part payment for the construction of the mall and the evacuation of the artisans who were hitherto occupying the 28-acre land meant for the project.

Mr. Obosu who is the initiator of the project, upon sensing greed in the transaction, ran to court suing WDCL and West Port RMB Limited, a South African Investor who was to fund the project, as first and second defendants respectively.

Mr. Obosu sought the Court to stop the 2nd defendant from making any payment to the 1st defendant in respect of the project and an order for the court to disburse the said payments between the plaintiff and the 2nd defendant.

This, the court granted.

The court also restrained WDCL from starting development or doing any work on the land in question until and unless the payments have been effected and disbursed as determined by the court or otherwise settled or agreed.

A cost of five thousand cedi was also awarded against the defendants.

The Court in its ruling also upheld the plaintiff as the rightful person whom WestPort RMB should deal with instead of WDCL.

The Takoradi Shopping Mall saga started in 2009,when  Mr. Obosu developed a concept to build a shopping mall in Takoradi and consequently approached an Investor from South Africa, P-Project, which expressed interest in funding the project but the latter could not provide money to start the project after a year, resulting in the abrogation of the contract.

Mr. Obosu subsequently approached West Port RMB Limited to fund the project which the latter agreed.

WDCL which is believed to have the full support of the current Mayor of Sekondi-Takoradi, Capt. Anthony Cudjoe, surprisingly got into the deal by secretly purchasing the 28-acre land meant for the project.
