KKD Rape Saga: It Will Spell Doom For The Country If Justice Is Determined By Complainants - Maurice Ampaw

A Private Legal Practitioner, Maurice Ampaw has disagreed with the position of some lawyers that rape victim, Ewuraffe Orleans Thompson’s statement to the court to discontinue the case is enough reason to free Showbiz icon, Kwesi Kyei Darkwa.

According to him, there is medical evidence and report made to the police that KKD raped the 19-year-old lady, asserting that the court can force the victim to court to give evidence regardless of the fact that she has withdrawn from the case.

Speaking on Okay FM’s "Ade Akye Abia" Morning Show, Maurice Ampaw insisted that Ewuraffe’s statement at the police sation supported by evidence at the crime scene coupled with KKD’s admission that it was consensual sex have made the case of the prosecutor stronger to continue.

“There is medical evidence and the report at the police even though she has withdrawn from the case in court is self-incriminatory for the prosecutor to continue with the case; the worse thing is that KKD has admitted he slept with her but it was consensual sex and this has somehow made the prosecutor case good….it has given weight to their case. To say that the lady should not be a star witness in this case means we are not being fair; if we allow complainants to withdraw cases, the effect will be too much for the justice system in this country,” he bemoaned.

He however maintained that the stance of many lawyers to throw away the case because the lady has withdrawn from the case will spell doom for the country if justice in criminal case is determined by complainants.

He urged that citizens must help in the fight against crime as it is not the duty of the complainant to determine whether there should be prosecution or not against someone who has committed a crime.

“The girl cannot turn down the court order to give evidence in this case; otherwise she will be in trouble. The moment she comes to court she will talk because she has already made a statement at the police; she wrote the statement and nobody forced her….”, he stated.
