STATEMENT: Shoddy Appeal Pending...AG Must Resign & AG's Office Overhauled - AFAG

The Alliance for Accountable Governance(AFAG) considers the call by Woyome for the AG to resign as legitimate and in line with conventional wisdom if the allegation is true. Not only that, the AG's office needs total overhauling.

It will be recalled that Woyome accused Lithur,Brew & Co as illegally persuing him to pay up their share of the Ghs 52 million judgement debt whereas they had been settled long ago under the regime of President Kufour. Indeed Woyome described Marietta Brew Oppong in court as been opportunistic and all of a sudden surfacing with Austro-Invest to pursue an illegitimate claim. A claim which had already been settled and company(Austro-Invest) dissolved.

Fellow Ghanaians, it comes as a shock to realise that, the discontinuation of the suit by Austro-Invest was because they benefitted from the illegal payment to Woyome. We understand the company Austro-Invest was dissolved in Switzerland way before Marietta Brew Oppong and Tony Lithur filed their claim.

Woyome thus have a good reason not to have used "awarded" but preferred the choice of the word "Benefit". This gives meaning to Justice Dotse's ruling on "Create,Loot & Share".  It implies Marietta Brew benefitted illegally from this bounty loot from state coffers.

Ladies and Gentlemen, this is a great indictment on the AG. It bothers on whether the president nominated Marietta Brew Oppong without due diligence or for the purpose of cover up on this case. As we speak, Ghanaians are yet to recover from the shock of Woyome's freedom on 2 counts of defrauding the state by false pretence and causing financial  loss to the state.

Fellow countrymen, the revealation by Woyome justify public attack on the AG's office for superintending over a weak prosecution. It indicates a gross conflict of interest and hence the lack of will for the AG to have joined Betty Mould Iddrisu, Barton Oduro, Nerquaye Tetteh etc. It justifies that, the default high court judgement setting the tone for Woyome's claim was well orchestrated. Hence the inability to have joined the above mentioned persons to the suit. Also, the lack of will made it difficult for the AG to set aside the default high court judgement making Woyome technically liable for his claim, although per the supreme court ruling there was no contract.

Fellow countrymen, this is crass corruption in the most sophisticated manner. Government must be worried about the turn of events. The president and his governments hands are tied up. They lack the will to be torough especially when Woyome had already warned of spilling the beans if he is pushed. The AG is not worthy of superintending over the case any longer. Additionally, the AG's office suffer the moral will to join a former chief state attorney too. Clearly, a murkier mesh of conflict of interest hangs around the neck of the AG if  Woyome's allegation is true.

RESOLUTION

On account of the fact that:

(i) Woyome has threatened to spill the beans if he is pushed, and for that matter government and the AG lacks the will to proof beyound doubt that Woyome was illegally paid,

(ii) a former chief state attorney(Nerquaye Tetteh) was indicted as having benefitted from Woyome's payment making it difficult for AG staff to join one of their own,

(iii) the AG was unwilling to set aside the high court default judgement making Woyome liable for the claim,

(iv) the AG has been accused by Woyome  as having "benefitted" from illegal payment of about $32 Mil,

(v) Marieta Brew was accused by Woyome for waking up a dead company Austro Investors to pursue a claim he had settled them already,

(vi) the AG is unwilling to prosecute Betty Moulds Iddrisu et. al. who adviced, effected and justified the payment,

The Alliance for Accountable Governance(AFAG) on the score of this, deem any appeal against Woyome as dead on arrival if the AG does not step aside, and the AG's office completely overhauled. Also, the state attorney handling the case must be replaced asap.
