As a way of ensuring that the testimony of a witness was accurate and compares exactly with the account of one of the parties in a suit, Justice E.K.B. Apenkwa, a High Court judge, on Monday decided to walk Mr. Ibrahim Mahama out of court.
The directive from the High Court 5 judge was to enable the court listen to what a witness for Mr. Ibrahim Mahama had to say.
The court was in session to hear a defamation case brought against Bernard Antwi Boasiako by Ibrahim Mahama, a brother of President John Mahama. Mr Ibrahim took legal action against the NPP chairman, who he claimed, accused him and President Mahama of siphoning state funds to enrich themselves during a public gathering at Obuasi in 2014.
Lawyer Egbert Faible, counsel for Mr. Antwi Boasiako, later explained to Peacefmonline.com that he was unable to cross examine witness for Mr. Ibrahim Mahama because the court was not able to make available records of the previous proceedings which occurred in his absence.
“I informed the court that because Zwennes (counsel for Ibrahim Mahama) actually led the witness in evidence on the last adjourned date in my absence, I have written to the court for the record of proceedings of that encounter so that I can cross examine the witness.
And as at this morning when I stood before the court, the record was not ready so we had to choose a date”, he said.
Ibrahim Mahama has filed a writ against the NPP Regional Chairman over a defamation charge claiming GH¢5 million as damages.
Mr. Ibrahim is of the view that the NPP guru defamed him by peddling falsehoods about him in public in April last year, so the court should order Wontumi to compensate him with the staggering GH¢5 million.
