High Court Dismisses Action For Re-Run of Election

The Ho High Court has dismissed an application filed by some aggrieved members of the New Patriotic Party (NPP) of the Ho Central Constituency that sought a rerun of the constituency executive election. The application, filed by 16 members led by a former executive, Mr Japhet Amoako, sought to nullify the mandate of the new executives on the grounds that their election was marred by procedural irregularities. The action was as a result of a dispute over the voters� register and the non-vetting of some of the aspirants. However, after battling the matter in court for seven months, the court, presided over by Mr Justice Patrick Baayeh, held that from the evidence on record, the election was properly and fairly conducted as it was open to all members. No illegality According to him, he did not see any illegality or fraud as due process was followed. Since it was a friendly contest, the court did not award any costs against the plaintiffs. The legal battle had hindered all activities of the party in the constituency, including the conduct of a primary to elect a new parliamentary candidate. With the case now resolved, the new executive would have the mandate to steer the affairs of the party in the constituency. The newly-elected chairman, Mr Richard Kuadekpo, described the judgement as victory for the party and called on all members to unite for a common goal of winning the seat for the NPP in the 2016 Election. Ho Central Primaries Meanwhile, the Regional Chairman, Mr John Peter Amewu, has said once the court case is out of their way, a date will soon be set after discussions with the national executive for aspirants to pick the forms and file nominations.
