Did you know that judges cannot authorize death sentences on convicts? Yes, it does not lie in the hands of any judge in Ghana to execute any person to death.

Following the shocking revelations by ace investigative journalist Anas Aremeyaw Anas regarding corruptible practices in Ghana's judiciary; socio-economic commentator Kwesi Pratt has sought to educate the public how a death sentence is given to convicts.

According to him, no judge in the country can sentence an accused to death because they are not the "final arbiters."

He revealed on Peace FM's "Kokrokoo" that the only authority that can authorize death sentence is President of the Republic, John Dramani Mahama.

Mr. Pratt told host Kwami Sefa Kayi that until the President assents to a sentence of death by the court, it is null and void a ruling to that effect.

“Even when comes to sentencing people to death, judges are not the final arbiters. Nobody can be executed without the signature of the President. It’s the President who is the final determinator. Even when it has been done by the judge, it takes the President to confirm a sentence of death and so on. So, in that sense, the judge is not the final arbiter. It is the executive which is the final arbiter.”

In respect of this, a President can either confirm or unconfirm such sentence; however whichever way it still behoves the court judge to execute the mission once the President has appended his signature.
