House Of Chiefs Under Fire

Wor-Nii Bortelabi Borkete-Laweh XIV, the authentic Chief of Nungua in the Greater Accra Region, known in Private life as Dr. Samuel O. Bortei-Doku, has threatened to drag the National House of Chiefs (NHC) to court should it refuse to do the right thing.

Already, he has written to the NHC to expunge the name of one Mr. Laryeafio Akatoi known as King Odaifio Welentsi III, styling himself as Nungua Mantse or face him in court if they continue to remain adamant.

According to him, he has realized the ‘fraud’ of Mr. Justice Akatoi as well as the scandal of NHC and if things are not put in it right places, the court would be a proper place to expose NHC as a very corrupt institution, denting it image.

Wor-Nii Borkete-Laweh XIV, in a release dated 21st December, 2015 recalled the alacrity with which NHC expunged the name of OdaiAyiku IV from the register when the travelled to the Supreme Court but without a formal letter written to it and wondered why the body had remain mute on the issue of the self-styled chief.

He,  however, do not understand why despite a Supreme Court judgement on 2009 CIVIL APPEAL J4/16/2009 pronouncing him (Wor-Nii Bortelabi Borkete-Laweh XIV) as the authentic Mantse, NHC would still drag its feet in removing the name of Akatoi from the register after four years.

Extract 497 dated 28th September 2011 from the National House of Chiefs purports Mr. Laryeafio Akatio was installed as the chief of Nungua on 10th March 1994 but the legitimate chief challenged it given that a rejoinder of the Elders of the Oswe stool in the Ghanaian Times of March 23rd 1999 to the announcement of the installation of Wor-Nii Bortelabi Borkete-Laweh as Nugua Mantse, stated that they had not enstooled any chief since 1991.

He was marveled that during his installation as the Nungua Mantse which same was published in the Ghanaian Times of 16th March, 1999, Mr. Laryeafio did not react, adding that he was again silent when Nii Odai Ayiku IV sued the Attorney General in the High Court and was declared as the lawfully enstooled Nungua Mantse in 2001.

Wor-Nii Borkete-Laweh XIV however feeling injuriously affected and his capacity as the Nungua Mantse challenged, took out summons against both Nii Odai Ayiku IV and the Attorney General, to have the default ruling set aside.

In 2005, the High Court, presided by Justice Asamoah, J, set aside the default ruling of Justice Ebiasah which had declared Nii Odai Ayiku as the Nugua Mantse.

“At this point, a criminally falsified version of the Justice Richard Asamoah ruling was deposited at the Ga Traditional Council, with the name of the applicant, Wor-Nii Bortelabi Borkete-Laweh XIV, deleted and the High Court Registrar’s signature forged”, alleged.

Thereafter, in November 2005, Mr. Akatoi was inducted into the Ga Traditional Council but the induction was nullified in June 2006 by the High Court presided by Justice Mr. J. Benson.

Mr. Akatoi was said to have defied the nullification of his induction and was convicted of contempt of court in November 2009.

Meanwhile, Nii Odai Ayiku IV, dissatisfied with losing his case in the High Court, appealed. The Appeal Court on 31st July 2008 unanimously dismissed his appeal CORAM; E.K PIESARE, J.A (PRESIDING); MARIAMA OWUSU, J.A and YAW APAU, J.A.

Nii Odai Ayiku IV still displeased went to Supreme Court where it also unanimously dismissed the appeal. CORAM: W. A. ATUGUBA. JSC (PRESIDING); J. ANSAH, JSC; S.O.A. ADINYIRA (MRS), JSC; R.C. OWUSU (MS), JSC and B.T. ARYEETEY. JSC.

The statement pointed out that Mr. Laryeafio Akatoi fully aware that he was not a party to this suit fraudulently presented the Supreme Court judgment, given in favour of Wor-Nii Borkete-Laweh XIV as supporting document to NHC for his registration.

It posited that Mr. Laryeafio Akatoi dishonestly got some newspapers to publish that he had been declared chief of Nungua when no court ever pronounced him a chief.

Wor-Nii Borkete-Laweh XIV in the statement accused NHC of willfully disregarding a letter cautioning the President of dubious maneuvers to register Mr. Laryeafio Akatoi.

He further accused NHC for registering Mr. Laryeafio Akatoi in 2011, although his membership of the Ga Traditional Council had been nullified since 2006.

“The Research Committee Report from the Greater Accra Regional House to the National House was not signed by the Chairman of the Regional House Research Committee. The National House was aware that when it’s Judicial Committee, chaired by Nana Kwamena Ansah IV, ruled on the Nungua case on 15/8/07 it did not pronounce Mr. Akatoi as the chief of Nungua”, he underscored.

WOr-Nii Borkete-Laweh XIV has therefore advised the National House of Chiefs to similarly write to “King Welntsi III” that in view of the Supreme Court Judgement, his name has been expunged from National Register of Chiefs.

“Now with broad daylight assassination attempts on Wor-Nii Borkete-Laweh XIV, the four years adamant retention of the name of King Welnetsi III” in the National Register of Chiefs, in blatant defiance of the Supreme Court and tenacious violation of the 1992 Constitution, tends to highlight a message; that the National house of Chiefs is buying time and providing cover for the fakes to succeed with their murderous plots”, he said.
