Afotey Agbo Contempt Hearing Stalls

An Accra High Court on Friday could not hear the contempt of court proceedings brought against Nii Laryea Afotey Agbo, the Greater Accra Regional Minister and two others due to procedural hitches.

Frank Davies, lawyer for the plaintiff, had objected to the court allowing the Attorney General (AG) to rely on documents filed by Ayikoi Otoo, who had been thrown out of court for lacking the capacity to defend the minister.

Mr. Davies was of the view that in so far as the contemnor-Afotey Agbo-was now being represented by a new lawyer, it was right, per the court processes, that the AG would file new processes on his client’s behalf and not to rely on the previous documentations made by the previous lawyer who was eventually withdrawn from the case.

This however, compelled the trial judge to adjourn the case until April 14 to allow the AG to file the necessary Affidavit and papers on the behalf of his client.

John Kudalor, Inspector General of Police (IGP) and the Attorney General (AG) are defendants in the suit.

The three were dragged to the court by Kwadwo Asante Boateng aka Kwadwo Baah Asante, a livestock farmer, for obstructing an order of a high court over some parcels of land at Amarhia.

He had sued the defendants for failing to execute an order for writ of possession to him over the parcels of land which were a subject of litigation.

Meanwhile, even before the court would decide on the matter, Kwadwo Baah last month narrowly escaped death as a group of persons suspected to be land guards of Afotey Agbo, allegedly accosted him.

Daily Guide learnt that the land guards asked Kwadwo Baa to leave the land he had acquired in 1978 because it belonged to Afotey Agbo and his family.

The source further stated that although Kwadwo Baah had registered the land at the Land’s Commission in 1982 and title issued in 1998, the land guards warned him to stay away from the property or risk being killed.

When contacted for comments, an aide to Nii Afotey Agbo said he would pass the message onto the minister for an interview, which he never did.

As at press time yesterday, the minister was not available for comments as he could not be reached via his mobile phone.
