More Tension Over Flower Pot Lands

The controversy over ownership of Flower Pot Land on the  Spintex Road in the Greater Accra Region is far from over as renewed tension broke out again with one Siriki Awal alleged to have employed the services of ruthless land guards to illegally take over the said land.

In view of this, Gabriela Avadu and Chris Avadu have filed a writ at the High Court of Justice seeking a declaration of titles to all the parcel of  land, an order of perpetual injunction to restrain the defendants, their assigns, workmen from dealing with the land or disturbing the Plaintiffs enjoyment of the land.

The Plaintiffs (Gabriela Avadu and Chris Avadu) are also suing for an order for the recovery of possession of the said land.

In their Statement of Claim which was filed on March 15, 2016, the Plaintiffs averred that there are the owners of a land situated along Spintex road near Bank of Ghana office complex, measuring 0.509 acres.

According to them, Siriki Awal claims to be a dealer in lands and have employed land guards who have trespassed on their land hence not allowing anybody to develop the land.

Gabriela Avadu and Chris Avadu also mentioned that in 1999, the land was assigned to them by Standford Developing Company, after which they acquired title document plotted in their name at the Lands Commission Secretariat and further went into immediate possession of the land.

They stated that, they have uninterrupted possession and control over the land until January 2016, when they decided to construct a fence wall around the land.

However, the Defendant (SirikiAwal) and his land guards invaded the land preventing them from constructing the fence wall.

The Plaintiffs also pointed out that, when the Deed of Assignment was executed in their favour, they took steps to have it registered at the Lands Commission.

Notwithstanding all documents as regards their ownership to the land, anytime they visit the land, there are confronted by landguards on motorbikes who come around and threaten them.

The matter had been reported to the Property Fraud Unit of the Ghana Police Service which dispatches police personnel to the area, but anytime the police come around the land guard’s escape hence the police was unable to make arrests.

Meanwhile, searches conducted by the Plaintiffs at the Lands Registry show that the said landed property is plotted in their (Plaintiffs) name, hence prayed the court to prevent the Defendant from forcefully taking over their property.

The Defendant (Siriki Awal) has been embroiled in land litigation in the said area which nearly resulted in bloodbath.
