The Counsel for Gregory Afoko, alleged to have murdered the Upper East Regional Chairman of the New Patriotic Party, (NPP), on Friday moved a motion for bail, praying an Accra Criminal High Court to grant the accused bail.
According to the counsel, Isreal Ackah, the accused, has people of high repute and substance prepared to stand as surety for him (accused).
He said that there were no ongoing police investigations, and that the accused is a citizen of Ghana with fixed place of abode and ready to deposit his passport.
The lawyer for the accused further told the court that his client was ready to satisfy the conditions of the court.
He contended that the police took the finger print of the accused, however, there was nowhere in the bill of indictment which the prosecution linked the finger prints to the evidence collected at the crime scene to that of the accused.
He pointed out that the prosecution’s evidence were not in support of the charge, and only based on hearsay.
The Counsel further relied on the Supreme Court ruling on non-bailable offences in the case involving Martin Kpebu and the Attorney General, in which it struck out the law regarding the offences.
However, the Chief State Attorney, Mathew Amponsah, who objected to the application, was unable to make his submission.
Consequently, the court presided over by An Appeal Court Judge sitting as an additional High court Judge; Justice Lawrence Ladzaglah Mensah adjourned the case to June 28 for the prosecution to make their submission.
The counsel for the accused was expected to move a motion for bail filed before the court at the last adjourned day.
However, Justice Mensah could not hear the case and later adjourned it.
At the last sitting on June 14, the Counsel for the accused filed a motion for bail at Court, praying it to grant the accused, who is currently in prison custody bail.
It would be recalled that the Court on May 13, remanded the accused from the Police custody, into the Nsawam Prisons.
That was after the Chief State Attorney, Mathew Amponsah, made the request, telling the court that the East Legon Police cells where the accused was kept, was becoming congested.
Counsel for the accused, Ekow Ampah Korsah, had opposed the prosecution’s plea, saying it could hinder the trial, because cases of persons remanded into custody normally delayed due to various reasons.
However, the court remanded the accused to prison custody.
The judge said that it would be proper for the accused to be kept in prison custody because the trail had started.
