Receiver of UniBank Takes Dr. Duffuor, 16 Others To Court

The Receiver of uniBank Ghana Ltd, Nii Amanor Dodoo has brought a suit against the Founder of uniBank, Dr Kwabena Duffour and 16 others in the infamous bank collapse.

The Plaintiff's claim is that among other things the court declare that “the assets mentioned in paragraphs 31 and 32 of the Statement of Claim, as well as all other assets identified in this matter to have been acquired with the funds unlawfully taken of Unibank Ghana ltd, and within the possession or control of any of the Defendants, are held in trust for Unibank Ghana Ltd."

The Receiver, among other things, is seeking an order of the High Court directing that Dr Duffour and the defendants be held liable and made to repay an amount of ¢5,712,623,145 owed the bank.

All the 17 defendants are directors, shareholders and debtors of the defunct bank.

A claim for "An order directing the Defendants to return and/or transfer all the assets mentioned in paragraphs 31 and 32 of the Statement of Claim, as well as all other assets identified in this matter to have been acquired with the funds unlawfully taken from Unibank Ghana Ltd to the Plaintiff.” 

The defendants include Hoda Holdings Ltd, Hoda Properties, Integrated Properties Ltd, Alban Logistics, Starlife Assurance, Opoku-Gyamfi Boateng, Dr Kwabena Duffuor II, Prof. Newman Kwadwo-Kusi, Owusu Ansah Awere, Ekow Nyarko Dadzie-Dennis, Clifford Duke Mettle,  Bolton Porfolio Ltd, Boatemaa Kakra Duffuor-Nyarko, Kofi Kyereh Darkwah, Nana Boakye Asafu-Adjaye and Alex Gaddiel Buabeng.

If you may recall, Nii Amanor Dodoo of KPMG was appointed as an administrator to manage Unibank when they started facing challenges for some six months.

However, shareholders of the bank issued a statement in which they accused KPMG of engaging in a conflict of interest arrangement with the Bank of Ghana.

According to a statement by the shareholders: “The recent appointment of KPMG as the Receiver in respect of some assets of uniBank and four other banks shows KPMG seeking to benefit from the report that it provided to the Bank of Ghana through a further paid engagement, a clear conflict of interest situation which does not put KPMG in a good light.”

The petitioner wants a declaration from the court that the directors of uniBank breached their duties and must be made to answer for same
