Ofosu Ampofo's Counsel Should Apologise To Tiwaa...Police Can Order Your Arrest If Invitation Is Ignored – Lawyer

Private Legal Practitioner, Lawyer Gary Nimako Marfo, has stated that the Ghana Police Service has every right to go for an arrest warrant from court if one refuses to honour its invitation.

The Criminal Investigations Department of the Ghana Police Service on Wednesday invited NDC National Chairman Samuel Ofosu Ampofo again for questioning in connection with kidnappings and market fires across the country. He was to present himself to the police on Thursday.

But Mr. Ofosu Ampofo declined the invitation, insisting the position of the CID is just to “shift the blame over the increasing inability of the security agencies” to ensure safety of citizens.

Through his legal team headed by Godwin Edudzi Tamakloe, the NDC Chairman claimed Madm Tiwaa Addo-Danquah is in bed with the NPP thereby doing everything possible to get the attention of the president for the position of the Inspector General of Police (IGP) which will soon be declared vacant.

– “Your invitation, its tone and insinuations, is simply an attempt to 'pass the buck', and shift the blame over the increasing inability of the security agencies, including your outfit, to manage and control the failures of security and the governance structures of the country as a whole. Looking for scape-goats would not improve the situation," counsel for the NDC Chair indicated.

Commenting on the decision by the NDC National Chairman to decline the police invitation, Lawyer Nimako pointed out the police administration is an institution of the state that is governed by rules and regulations, and that the law of the land is no respecter of persons.

“The law does not care about ones stature in society, whether small or big, it is immaterial," he said.

Reiterating his point on Okay FM’s "Ade Akye Abia" Programme with Kwame Nkrumah Tikses, lawyer Nimako averred that "if one refuses to honour an invitation of the police and they feel to arrest the person they have the right to do so".

“ If tomorrow the CID boss Maame Tiwaa is not there, the institution will still be there…we don’t trample upon an institution of state all in the name of politics...The CID is not Maame Tiwa but an institution of state…the fact that she sign the letter doesn’t mean she is the CID…you can’t talk like that, it is wrong,” he chided.

He wondered if "the police cannot do their work anymore…they are doing a criminal investigation …so all that you have to do is to say whatever you know if you don’t have anything you tell them… What he said was wrong because in law the police has every right to invite anybody to assist in investigation… Even if the person is not  interested in helping in investigation, if someone mention your name over an issue they can invite you to assist in their investigation".

He made it clear that "an invitation is not an arrest warrant so Lawyer Tamakloe should apologize to Maame Tiwaa for tarnishing her image,”.
