Eugene Baffoe-Bonney, a former National Communication Authority (NCA) Board Chairman has gone to the Court of Appeal to seek a reversal of a High Court decision requesting him to open his defence.
The High Court presided over by Mr Justice Eric Kyei Baffour after the close of the state's case called on Baffoe Bonney to open his defence.
The former NCA Chairman, however, filed a submission of no case, which the High Court dismissed.
Baffoe Bonney has therefore filed a stay of proceedings at the High Court so that his appeal could be heard by the Court of Appeal (CA). Lawyers of the accused drew the court’s attention of the pending appeal.
The court then adjourned the matter to November 26 awaiting the decision of the CA.
Baffoe Bonney is standing trial with four others in connection with the purchase of a cyber-security surveillance equipment.
The other accused persons are Matthew Tevie, a former NCA Director-General, Nana Ensaw, a board member, Alhaji Osman Mimina, a former Deputy National Security Coordinator and George Derrick Oppong, a businessman.
They have been variously charged with conspiracy, stealing, wilfully causing financial loss to the state, money laundering, using public office for private gain and misapplying state property in contravention with the Public Procurement Act.
They have denied the various charges and are on bail.
In 2015, the accused persons without authorisation allegedly purchase a cyber-security surveillance machine to among others check terrorism.
The said machine has had some parts missing and could not be used for its intended purpose.
