Why Go To Court Without Your Own Pink Sheets? - Gary Nimako Queries Mahama

Lawyer Gary Nimako has slammed Presidential candidate of the opposition National Democratic Congress (NDC), John Dramani Mahama for filing a motion at the Supreme Court asking the Electoral Commission (EC) to furnish him with the 2020 Presidential election pink sheets.

The former President, a petitioner before the highest court of the land challenging the legitimacy of Nana Akufo-Addo's presidency, has prayed the court for the EC to provide him all 275 original copies of constituency collation forms for the Presidential elections.

He filed the motion through his lawyers on Tuesday, January 19, 2021.

Mr. Mahama also wants the EC to make available originals of the Constituency Presidential Election Results Summary Sheets and the Regional Presidential Election Results Collation Forms.

Mahama's Motion 

The originals of the Constituency Presidential Election Results Collation Forms (Form 9) for all constituencies in Ghana;

The originals of the Constituency Presidential Election Results Summary Sheets (Form 10) for all constituencies in Ghana;

The originals of the Regional Presidential Election Results Collation Forms (Form 11) for all regions in Ghana;

The originals of the Regional Presidential Election Results Summary Sheets (Form 12) for all regions in Ghana;

The original of the Declaration of the Presidential Results Form (Form 13);

The records of the alleged update to the purported declaration of presidential election results on 9th December 2020, of the results of four Constituencies in the Greater Accra Region.

Why Go To Court Without Pink Sheets?

Lawyer Gary Nimako has questioned the petitioner's logic in seeking pink sheets from the election management body when he (John Mahama) was declaring himself winner of the Presidential elections before filing his petition to challenge the results in court.

The lawyer asked on what basis was Mr. Mahama claiming victory if he didn't have the pink sheets.

He also wondered why Mr. Mahama would go to court to challenge the election verdict without having his own pink sheets.

Speaking on Peace FM's ''Kokrokoo'', lawyer Nimako offered a piece of advice to Mr. John Mahama saying ''they (Mahama's lawyers) should proffer cogent evidence before the court to let the court and Ghanaians know why they feel that President Mahama ought to have been the person who should have won the elections and not President Nana Akufo-Addo''.

"They must provide cogent evidence before the court. That's the only survival mechanism but if you don't present any cogent evidence before the court, the court cannot help you. Because the rule of the game is evidence and in this case, your evidence is your pink sheet and the numbers on your pink sheet must show that you had more numbers, which is 50 per cent plus 1, that's across the threshold to show you won the elections," he stressed.
