Atimpoku Fuel Contamination: No Show In Court As Case Adjourned To Jan 25

Representatives and lawyers for Oil Marketing Company, Shell (Defendant) were absent in court on Thursday, for the hearing of the case in which a businessman dragged them to court for sale of alleged contaminated fuel.

When the case was called before Justice John Bosco Nabarese, both the Defendant (Shell) and their lawyers were absent.

The judge noted he received information that lawyer for the Defendant is indisposed. Lawyer for the Plaintiff John Jaja who was minded to ask for cost rather waived it.

The businessman, Edmund Barwuah dragged Shell to Court for allegedly selling contaminated fuel to him.

The plaintiff in his statement of claim said, on August 28, 2022 he refuelled his Ford Explorer vehicle, 2017 model at the Atimpoku Shell filling station in the Eastern Region on his way from the Volta Region.

The plaintiff ( Edmund Barwuah) claimed that, the fuel sold to him was contaminated with water, a situation which endangered his life and that of his friend John Michael Appiah-Acheampong.

Aside that, he also missed an important business meeting he was scheduled for, worth Two Million, Five Hundred Dollars ($2,500,000.00) as well damages on car.

The plaintiff (Edmund Barwuah) is therefore praying the High court in Accra to give an order directing the Defendant (Shell) to replace his Ford Explorer vehicle, 2017 model with a similar vehicle and of same specifications.

He also wants the court to order the Defendant (Shell) to award him special damages of $2.5 million for the loss of business opportunity occasioned by the defendant's negligence and breach of contract.

Additionally he wants damages of Six Hundred cedis (GHC 600.00) per day for the loss of his car from 28th August, 2022 till Shell replaces his car with similar vehicle.

The case has been adjourned to January 25, 2024 for the hearing to commence.
