A former Board Member of the Ghana Gas Company, Valerie Sawyerr has gone to court seeking nullification of the Ghana Gas’ Forensic Audit report by government’s Cabinet Committee.
She stated in her writ that, “The Audit Report completed and submitted to the 2nd Respondent was made in breach of the rule of natural justice, audi alteram partem”.
The report - of the Cabinet Committee Responsible for the Coordination of the Investigations/Forensic Audit - which came out a few weeks ago, showed that helicopters purchased from China Aero Technology Import and Export Corporation were never used for the purpose for which they were purchased.
The report also alleges that equipment for the helicopters were never delivered even though they were part of the initial contract price.
These discoveries the Committee alleged, resulted from inflated contract sums, non-performance, non-enforcement and breach of contracts, and caused the State over $60 million dollars in financial loss.
However, Dr. Sawyerr, in a sworn affidavit to the Court, said the report was intent to breach her right after praying the court to annul the report, its findings, observations and recommendations.
“A declaration that the Audit Report which implicated me, as a former board member of Ghana National Gas Company Limited, was done in breach of my right to administrative justice and my right to a fair hearing.
“A declaration that the Audit Report which implicated me, as a former board member of the Ghana National Gas Company Limited, contravenes Article 23 of the 1992 Constitution.”
“An order of Certiorari bringing up into this Court for purposes of being quashed and quashing the Audit Report which was completed and submitted to the 2nd Respondent, and which implicated me as a former board member of Ghana National Gas Company Limited,” portion of the writ reads.
She therefore asks the Court to quash the report, its findings, observations and recommendations.
“An order of Certiorari bringing up into this Court for purposes of being quashed and quashing the Audit Report which was completed and submitted to the 2nd Respondent, and which implicated me as a former board member of Ghana National Gas Company Limited,” the writ added.
Valerie Sawyerr also wants the court to restrain the security agencies involved in the case to stop inviting her for questioning since to her such invitations are a form of “harassment.”

Mad Valerie should just go and bring the money, her share of the loot. It's a simple matter. The audit has shown that, Ghanaians monies have have it's way down the rabbit hole. Inviting you to show Ghanaians which rabbit hole our monies went is not harassment. So just go and tell them which rabbit hole it absconded through with your connivance or otherwise and let's pull it from the rabbit hole. Those monies can be used to clean up Accra, as an example of what such huge sums can be used for.

The NPP must not relent in their efforts to bring these good for nothing loud mouths to the courts of the land for justice to prevail. They cannot be allowed to walk free and talk rubiisshh whilst tax payers money entrusted to them for 8 years were recreated, looted and shared among themselves. We can never forgive the NPP is these guys are left to go scot free. No matter the side steps to delay the cause of justice we must endeavor to move on with the cases with the needed speed. Thank you Valentino. However if an activist judge is procured he will throw the case out on a technicality. One being that the report has not been actioned.
This woman looks too masculine in her face. Anyway, going to court is the right thing to do. The mouth mouth in the public media wasn't going to change anything. She's going to see her smoothness level in court.

The issues are: 1.Whether a cabinet sub-committee has the power to institute an audit aside the Auditor-General 2.Whether the report is an audit report or investigative report.If it an investigative report,who is the complainant? 3.Whether Ms Sawyerr was given a hearing and whether the hearing was fair. 4.whether she has been furnished with the draft report for which if necessary her comments on the draft should be incorporated into the final report. Interesting times for our courts.
