An Accra High Court has asked Ghana’s Electoral Commission to adhere to its own rules in the conduct of the 2016 general elections.
The court made the remark when it gave a judgment in a case brought by the Progressive People’s Party (PPP) which was challenging the disqualification of its flagbearer, Dr. Papa Kwesi Nduom form this year’s presidential race.
The EC disqualified the PPP flagbearer because according to it Nduom’s nomination forms were not properly completed.
But lawyers of the PPP argued in court that the EC did not give them the chance to correct the errors on their flagbearer’s nomination forms.
They had also prayed the court to stop the EC from going ahead with balloting of presidential candidates on the ballot paper.
Meanwhile the court presided over by Justice Eric Kyei Baffour on Friday ordered the EC to give the PPP the chance to make the necessary corrections on the nomination forms.
Citi News’ Fred Djabanor reported that “according to the judge, the regulations, C.I. 94 [the law governing the conduct of the 2016 elections] states clearly that if there is an error within the nomination period or nomination day, any candidate must be afforded the opportunity to correct his error.”
“The judge further said the EC failed to state clearly what a nomination period was and that what they only did was to just use two days for acceptance of nominations. He said the EC also failed to define what a nomination day and nomination period was…hence the EC couldn’t disqualify Dr. Nduom based on that,” added Djabanor.

not anyone with a qualification has common sense. management is a different ball game. many a time, you humiliate yourself trying to be dishonest. this time the dishonesty of the EC is showing clearly. looks like the supreme court is also inconsistent. last time the rule that signatures are not significant in electioneering,now the are talking about signatures again. for what? perhaps that is why we are africans as describe by Sir Lugard. inconsistently inconsistent, bringing wars to many impoverish African countries.
the EC is not only incompetent but attempting to cheat for the INCOMPETENT JOHN MAHAMA who has turned the finances of the country in something for sharing among friends and sympathizers. see how he is stea..liing the funds of the country without course to morality and ethics. as if he does not go to church or day dreams when the preacher is preaching. see how we are suffering whilst he boost of building schools,hospital, roads, airports which we cant afford. really shameful leader
But who says if you lose a case in court then it means you are incompetent. Losing a case in court is purely to the discretion of the presiding judge. It has less to do with the competence of lawyers. There are judges who take goats and yams to rule in favor of murderers so, don't even go there. So many innocent people are in jailed because of ruling by some drunkard who fought with the wife before giving his judgement.
Nothing stops the EC from going to the Supreme Court. EC should go to the Supreme Court to disorganize the campaign of these use.less party.
I thought the EC chair is a lawyer. Afari Gyan was not a lawyer but never made such mistakes. Is this embarrassment deliberate or a sign of incompetence. It looks as if there is a remote controller to the EC chair. Eyes are watching!

Ghanaians, especially Npp folks, are so ediotic. Just imagine the impact this is going to have on the bid on nana addo's attempt to be president. If nana Addo does not become president, it's the likes of ayikoi otoo. This ruling is going to make ndoum very popular and he is likely to split votes with both Ndc and Npp. To a large extent if he stands, many disgruntled Npp and Ndc supporters are likely to switch to him, making it difficult for Npp in particular to snatch one touch victory. In the event that the election goes second round and if Ndc gets majority in parliament John mahama is likely to be retained. The reason why Npp wants more parties to contest the election is because they presume there could second round, but what they have not considered is that votes garnered by other political parties together, could possibly affect their chances and probably give John mahama a first round victory. I strongly believe that the less parties on the ballots the brighter the chances of Npp or Ndc to win one touch. This ruling may be a blessing in disguise for the Ndc.
