The Supreme Court has struck out an application seeking to halt the oral examination filed by embattled businessman Alfred Agbesi Woyome.
A three-member panel presided over by Justice William Atuguba by a unanimous decision on Wednesday, 31st January, 2018 dismissed the application.
This follows another application he had filed to stop the process, seeking to retrieve the GHc 51 million judgment debt wrongfully paid to him by the state.
Mr. Woyome had prayed the Supreme Court to stay proceedings on the oral examination since he had filed for a review of the case.
But the apex court, on Wednesday ruled that allowing Mr Woyome to be orally examined does not breach his human rights as espoused by the embattled businessman.
Background
Mr. Woyome was paid the GHc 51 million after claiming he helped Ghana raise funds to construct stadia for the hosting of the 2008 African Cup of Nations.
However, an Auditor General’s report released in 2010, held that the amount was paid illegally to him.
Subsequently, the Supreme Court in 2014 ordered Mr. Woyome to pay back the money, after Martin Amidu, the Special Prosecutor nominee and a private legal practitioner at the time, challenged the legality of the payments.
Following delays in retrieving the money, Supreme Court judges unanimously granted the Attorney General clearance to execute the court’s judgment, ordering Mr. Woyome to refund the cash to the state.
There had been previous attempts to orally examine Mr. Woyome, with Mr. Amidu himself, in 2016, filing an application at the Supreme Court to find out how the businessman was going to pay back the money.
This came after the Attorney General’s office under the Mahama Administration, led by the former Minister for Justice, Marietta Brew Appiah-Oppong, discontinued a similar application.
In February 2017 however, Mr. Amidu withdrew his suit seeking an oral examination, explaining that the change of government and the assurance by the new Attorney General to retrieve all judgment debts wrongfully paid to individuals, had given him renewed confidence in the system.

Masa; Woyome will find some excuse and file another defence case at the court pretty soon but what he fails to understand is that NO JUDGE in Ghana today will find anything in his favour and if he is not lucky a case may be filed to annul the judgement of Ajet Nassem the fugitive judge who pronouced woyome a non criminal person ; woyome is playing with the balls of these judges at the SC ; he has no respect for these judges and thinks they are a JOKE !!!!!but this ewe/ayigbe man lie bad !!!!!1; the courts will start squeeezing his balls pretty soon and he will start naming the gang of bandits whom he shared the cash with ; get ready to roll Betty Mould ; Asiedu Nketia; Koku ; Kofi Adams ; Alex Segbefia etc .

cant this case be given to JSC Dotse to finalise it, seem we too much joking on the issue, i dont think the AG nor the government with the judiciary is happy to retrive it, this case is even important than the 2012 election petition, do we know the amount of moneyy we talking of?, please leaders in ghana, you must give us the respect, i wish there was a clause that, the CJ & JSC are to retrieve and be paid from that money their salaries or benefit, i dont think it will take that lenghty unnecessary time, CJ , speed up, you acting like police if they are not attacked, once a police man or men are attacked, you then see the seriousness of the police service. wish there will be that command that from february 2018, untill or unless wayome fraud money is retrived, no CJ, JSC or judge will be paid in ghana even with those on immediate retirement like G. woode, there we will see the judiciary as police in combating crime if its within their own skin

i cant believe the ndc judge Atuguba was on the panel and the decision is unanimous. wow! what went wrong! hahaha. Woyome u are on ur own now. ur cohorts are deserting u so look sharp be4 u will be the only man standing. keep the agreements u had with them (if any) tight otherwise u will be the sacrificial lamb.

It is just a matter of time. The NDC was part of this loot so they had no motivation to retreieve it. Now that they are in a comfortable lead, we will get our money back. SAAAAGYEWAAAAA!
