Lawyers of the flagbearer of the People’s National Convention (PNC) Atuguba and Associates have written to the Electoral Commission, Ghana (EC) to rescind its decision to disqualify Dr Edward Nasigre Mahama from the December 7 elections, within 48 hours lest they head to court.
Dr Mahama is among 12 presidential candidates disqualified by the Commission for irregularities with their nomination forms. According to the Chair of the Commission, Charlotte Osei, who made the disqualification announcement, Dr Mahama had many of his subscribers not properly signing his forms.
Two of his subscribers, Abaako Issifu and Abudu Ayuba, for instance, were cited by Mrs Osei to have signed for another presidential candidate. But in the letter written to the EC, the PNC says the reasons were not tenable per the independent investigations conducted by the party.
Lead counsel Dr Raymond Atuguba says the EC must rescind its decision or face a legal tussle.
If it goes ahead to sue the Commission, the number of suits against the Commission over the disqualifications will come to four.
Flagbearers of the Progressive People’s Party (PPP), National Democratic Party (NDP) and the Great Consolidated Popular Party (GCPP) have sued the Commission and, in some cases, the Attorney General.

This is what happens when an exercise of discretion with too much power is spilled over the holder of the power. Mrs. Osei Charlotte, this is Ghana. it is a country and not your property. The Constitution vests sovereignty in the people of Ghana and not the President who you worship. Law has knowledge and its application goes with wisdom. As a lawyer, go back to your jurisprudence notes. There may not be elections coming up as planned because the EC will face a barrage of suits. Disenfranchising candidates where the law is not expressly clear on same is wrongful.You are not more powerful than any body in this country. You will die and also land in the 6 feet. If Mahama can take you to heaven, remember you will account for every drop of blood that will be lost in this country, should your decision lead to unrest in this country. And it is only a ***barred word*** that can say that war can never happen in Ghana. if you need proof of this, check Ivory Coast some years back.
